By accessing or using the HigherScore platform, mobile application, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

HigherScore reserves the right to modify these Terms at any time. Continued use of the Service after any modifications constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 21 years of age to use the Service. By using HigherScore, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

The Service is intended for use in jurisdictions where cannabis is legal for medical or recreational use. You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify HigherScore immediately of any unauthorized use of your account.

4. Loyalty Program Terms

HigherScore enables cannabis brands and dispensaries to create and manage loyalty programs. Each participating brand may have additional terms and conditions for their specific program.

• Points have no cash value and cannot be exchanged for currency
• Points may expire according to program-specific rules
• Rewards are subject to availability and may change without notice
• HigherScore is not responsible for rewards provided by participating brands

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to manipulate, falsify, or abuse the loyalty point system
• Create multiple accounts to circumvent program limits
• Interfere with or disrupt the Service or servers
• Attempt to access accounts or data belonging to others
• Use the Service if you are under 21 years of age

6. Intellectual Property

The Service and its original content, features, and functionality are owned by HigherScore and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without express written permission from HigherScore.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HIGH SCORE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

HigherScore is not a cannabis retailer and does not sell, distribute, or dispense cannabis products. We provide a technology platform for loyalty program management only.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIGH SCORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
